Common sense has gone to the dogs at the Auckland City Council after a dispute over $300 ticket turned into a $20,000 legal battle. The saga began when a summons was posted to Whangaparoa resident Jane Siemer following an anonymous complaint alleging her pet schnauzer had “charged a person” in early 2011. The Council prosecuted the fine but failed to notify Mrs Siemer of the court hearing which resulted her contesting the criminal charge and fine. A rehearing was ordered but...

NEW ZEALAND COURT PRACTICE BRINGS U.N. COMPLAINT
The practice of denying court access in New Zealand based upon (lack of) 'property' resulted three weeks ago in a formal complaint being made to the United Nations Human Rights Committee in Switzerland. The 'security for costs' regime in New Zealand courts requires poor plaintiffs pay into court the expected legal costs of the defendants before a hearing will be allowed. Rich plaintiffs do not pay security. The court rules state security must be paid if the plaintiff cannot afford their adver...

New Zealand a nation of cheats and thieves - survey
A large number of Kiwi adults have admitted to lying, cheating and stealing, figures in a new Colmar Brunton survey show. Of those surveyed, 81% of adult respondents admitted to cheating of some kind, including 36% cheating in a relationship and 22% at work. Comparative figures show that 92% of young people are self-confessed cheats. Colmar Brunton's Spencer Willis said that the survey also showed that not only are adults cheating on their partners, but they are lying to them too. Willis said that hal... -

A-G Finlayson Man of the Year
On the heels of Attorney General Chris Finlayson being tagged New Zealand politician of the year by political newsletter Trans-Tasman, New Zealand legal blog kiwisfirst has named him 2012 Man of the Year. Mr Finlayson had an extraordinary year. His popularity within the bureaucracy and legal community eclipsed that of popular Prime Minister John Key. The blog claimed Mr Finlayson selected himself for Queen's Counsel appointment on 13 December for his "contributions as Attorney General". ...

Cops on the wrong side of the law
At least 67 police staff have been arrested in the past three years while serving on the force. Some of the charges include dealing LSD, assault, drink-driving and theft. The Police Association say even one arrest was too many. In the year to August, 10 police staff - sworn and non-sworn - had been arrested on charges including assault with a blunt instrument, theft of property under $500, theft of a motor vehicle and drink driving. The districts which led the criminal behaviour were Canterb...

Jailed tax accountants to appeal
The two Wellington accountants who were last year handed the longest jail terms in a New Zealand tax case are appealing their convictions, claiming Inland Revenue trained their clients in evidence against them. David Ingram Rowley and Barrie James Skinner were last year jailed for eight and eight-and-a-half years respectively, after Justice Kos found them guilty on dozens of charges of fraud, tax evasion and attempting to pervert the course of justice. During sentencing Justice Kos also said the pai...

Petty drug users fill jails
Smoking cannabis is no worse than eating junk food or gambling, according to a new report by an independent panel of experts. The UK Drug Policy Commission, which has been researching drug use for six years, believes people who grow a small number of cannabis plants should be treated leniently. In New Zealand, hundreds of people are locked up for petty drug offences every year - many for crimes our top legal body says should not exist. Justice Ministry figures show a significant amount of court t...

by adminDame Lowell Goddard, the New Zealand judge who resigned last week as chair of the £100 million (N$183.5m) Independent Inquiry into Child Sexual Abuse (IICSA), did not leave her post voluntarily but was effectively fired. Dame Lowell, appointed by then-Home Secretary Theresa May just over a year ago, had already lost the confidence of senior staff and members of the inquiry panel, according to two well-placed legal sources.
