  • Phillip Smith's Brazilian judge busted

    While convicted murderer Phillip John Smith continues to run the gauntlet of the New Zealand court system since his deportation to New Zealand from Brazil late last year, an interesting postscript to this saga which gripped the nation after Smith fled under a false passport while on temporary release from prison has been revealed last week by the Wall Street Journal.

    The Brazil Judge who ordered Smith’s deportation, Judge Flavio Roberto de Souza (pictured), has been forced into early retirement after he was found driving a Porshe Cayenne seized from former high-flyer businessman Eike Batista, currently facing State prosecution for various financial crimes.

    According to a court statement, Judge de Souza also inappropriately took two watches, a Rolex, a Bulgari, and a piano which also belonged to Mr. Batista.

    De Souza had been the judge in Batista’s trial, a man who may hold the Guinness World Record for loss of wealth, with a reported US $32 Billion blown between 2012 and 2014.
    De Souza said of Batista a year ago, after the first hearing, “"Eike is a symbolic figure, I always say he was the poster boy of his own companies and with a megalomaniac dream of becoming the world's richest man. To see a person with that type of attitude sitting on the accused bench is really a historic moment."

    De Souza is not expected to face charges and will maintain his judicial pension.

    Back in Aotearoa, Smith’s lawyer Dr Tony Ellis has won the right to cross-examine the NZ Police Commissioner who issued 23 press releases during Mr Smith’s short absence from New Zealand. The Crown prosecution had signaled its intent to appeal this ruling but no appeal has yet been filed.
